Terms and Conditions
I. General Provisions and Definitions
1. Lipigo, š. f. is a student company operating within the educational program JA Slovensko, n. o., and its activities are carried out as a school educational project.
2. General Terms and Conditions (hereinafter referred to as the Terms and Conditions) apply only to business relations between the buyer and the seller:

concluded through the online store www.lipigo.sk (hereinafter referred to as the Store)
3. The Buyer is understood to be a natural or legal person who sent an order through the portal www.lipigo.sk.
4. The Order is understood to be a sent electronic form containing information about the Buyer, a list of ordered goods from the Store's offer and the total price of the order, processed by the Store's system.
5. The General Terms and Conditions further regulate and specify the rights and obligations of the operator and the buyer in their current version.
II. Order, conclusion of contract and withdrawal from the contract
1. The condition for the validity of an electronic order is the true and complete completion of all data and requirements required by the system during registration or when executing the order.
2. All received electronic orders are considered a proposal for a purchase and sale contract and are considered binding for both parties involved.
3. The buyer may cancel the order immediately after it is sent, before its completion.
4. The operator accepts the proposal for a contract from the buyer by delivering the goods to the delivery address of the buyer.
5. The invoice (tax document) will be sent to the email entered in the order form. All data necessary for the payment will be notified by email only after the order is completed. Failure to pay the invoice is considered a violation of the terms and conditions.
6. The operator reserves the right to deliver only the quantities of items ordered by the buyer that are actually available. The buyer will be informed of such a situation.
III. Delivery terms and terms
1. The place of performance of the contract is understood to be the residence (registered office) or place of business of the buyer specified in the store registration form or in the order form. The goods will be delivered by the operator using the services of third parties (Slovenská pošta, Slovak Parcel Service), or will deliver the goods by its own means, or. based on an agreement with the buyer.
2. Delivery of the goods is carried out by handing them over to the buyer, or to the post office, or to the first carrier for transportation to the buyer.
3. Ownership of the goods passes to the buyer subject to payment of the purchase price in full.
4. The operator will process the order and send the ordered goods to the buyer as soon as possible (standard within 5 working days) after receiving the electronic order. Failure to deliver the goods within 31 calendar days entitles the buyer to withdraw from the contract.
5. The buyer undertakes to take over the bindingly ordered goods. In the event that the buyer does not accept the goods, the seller reserves the right to assert his claim for compensation for the damage incurred. In the event that the customer does not accept the goods at the first delivery attempt and requests redelivery of the goods, he is obliged to pay the costs of the first, redelivery of the goods, as well as the costs of returning the goods to the seller.
6. The seller reserves the right to change the method of delivery of the shipment if the nature of the ordered products does not meet the requirements of the carrier.

IV. Purchase price and payment options
1. All prices listed on www.lipigo.sk include VAT and are valid at the time of sending the order.
2. The purchase price is payable no later than upon receipt of the goods (cash on delivery) or on the date stated on the invoice (in case of advance payment), unless both parties have agreed otherwise.
3. The operator reserves the right to request advance payment from the buyer without giving a reason, usually in cases where the delivery costs exceed the amount of the ordered items.
4. In case of refusal to pay for the order in advance, the operator considers the order invalid.

6. We use the STRIPE payment system for online card payments.
V. Warranty, complaints, documents
The operator will provide the buyer with all relevant documents related to the goods, including: Invoice - tax document. The buyer will receive the invoice by email. We will send you a printed paper form of the invoice only upon request. Please state this in the order note.
The operator provides a warranty for the delivered goods for 24 months from the date of sale.
The operator is responsible for defects that appear on the sold goods during the warranty period due to a material defect, a functional error, or defects caused by production.
The warranty does not apply to defects caused by improper handling, inappropriate handling, use or installation, electrostatic discharge, or defects caused by excessive mechanical wear. The warranty also does not apply to damage caused by natural disasters, natural disasters, violent damage, weather conditions, or operation in extreme and unusual conditions.
The buyer is obliged to inform the seller at the contact email address of any damage to the ordered goods by a third party (carrier) without delay and is obliged (in the case of claiming compensation for damage) to write a record of the damage with the courier, which he will submit to the seller when making a complaint. Without a written record of the damage signed by the courier, the complaint will not be considered justified.
The warranty expires in the event of unauthorized intervention in the goods by a person who was not expressly authorized by the operator or manufacturer of the goods to carry out the intervention.
VI. Postage and packaging
The operator reserves the right to change the form of transport when ordering goods that, despite their weight, do not meet the conditions of the selected form of transport, or fall into a higher price category of the carrier by weight after packaging.
Postage is governed by the contractual prices of the Slovak Post and the contractual prices of the company Slovak Parcel Service s.r.o.
The price for postage and packaging will be displayed in the shopping cart when ordering by the buyer based on the weight of the order.
VII. Act No. 18/2018 Coll. On the Protection of Personal Data, as amended
- Personal data is processed in accordance with Act No. 18/2018 Coll. on the Protection of Personal Data, as amended. The Operator does not provide the Buyer's personal data to a third party, except for the selected transport company that ensures the delivery of goods or services, or to state authorities in the event of an inspection, or to an intermediary, based on a mutual contract concluded in accordance with Act No. 18/2018 Coll. The Operator is obliged to secure personal data before they are made available to unauthorized persons, by taking appropriate technical and organizational measures. All employees of the controller are also obliged to maintain confidentiality in relation to personal data. The data subject has the rights defined in accordance with the provisions of Section 19 et seq. of Act No. 18/2018 Coll. on the protection of personal data as amended, namely: a) the right to information, which is fulfilled by this content and the terms and conditions, b) the right to request access to personal data concerning the person concerned - § 21 of the Act consists in your right to demand in what way and for what purposes your data is processed, and you can address this request to the contact e-mail., c) the right to correct personal data - § 22 of the Act allows you to correct personal data if they are out of date, d) the right to delete personal data - § 23 of the Act you will use if you are not interested in the operator further processing personal data, e) the right to restrict the processing of personal data - § 24 of the Act you will apply if you believe that personal data has been processed in violation of the law, f) the right to object to the processing of personal data - § 27 of the Act, g) the right to the portability of personal data, h) the right to file a complaint with the supervisory authority in relation to processed personal data. The operator obtains the following personal data from the buyer: title, name, surname, address, delivery address, billing address, telephone number, e-mail address, which are processed for the purpose of correctly processing your order. This personal data is stored for 10 years for archiving purposes. As part of processing the order, personal data is processed for the purpose of issuing invoices, resolving complaints, issuing warehouse (delivery) lists, ensuring transport, as well as accounting. The buyer may withdraw his consent at any time by sending an Appeal with the processing of personal data, and we will immediately delete it.
- In accordance with Act No. 18/2018 Coll. on the protection of personal data and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, I voluntarily agree to the management, processing and storage of my personal data by the operator Lipigo, s.f. specified in the online order, which I provided to the above-mentioned operator via the website www.lipigo.sk. When processing personal data, there will be no cross-border transfer to third countries. Personal data will not be published. Personal data will be provided to third parties such as courier companies for delivery purposes and to third parties on the basis of special regulations such as the Slovak Trade Inspection, the Tax Office and the like. Consent can be revoked at any time, otherwise the consent will expire after 10 years from the date of its granting and the data will be anonymized. The data subject has the right to correct incorrect, incomplete or outdated personal data, to destroy or block personal data.

VIII. Final and transitional provisions
1. These General Terms and Conditions and prices apply in the wording stated on the operator's website at the time of sending the electronic order, unless otherwise agreed between the two parties.
By sending an electronic order, the buyer accepts without reservation all provisions of the General Terms and Conditions in the wording valid at the time of sending the electronic order. The buyer will receive a copy of the Terms and Conditions with the confirmation of order fulfillment.
3. Relations between the two parties that are not regulated by these General Terms and Conditions are governed by the relevant provisions of the Commercial Code and other related legal regulations.
Any disputes between the parties that cannot be resolved by mutual agreement of both parties will be decided by the competent court.
5. Buyers are entitled to use the online dispute resolution platform (hereinafter referred to as "ODR") to resolve their disputes, in the language of their choice. The Buyer may use the ODR platform for alternative dispute resolution, which is available at the website http://ec.europa.eu/consumers/odr/ . When submitting a complaint to the ODR platform, the Buyer shall fill in an electronic complaint form. The information submitted must be sufficient to identify the relevant online alternative dispute resolution entity. The Buyer may attach documents to support his complaint. The Seller recommends that the Buyer first use the contact at www.lipigo.sk to resolve the situation.
